France and illegal downloading of music

A few days ago, Denis Olivennes has delivered his report about music downloads.

His solution : force the internet providers to menace their clients that are downloading and then terminate their internet connection if they keep doing it.

I've made myself clear more than once that I'm against illegal downloading, but this report challenged me :

1. how will providers make a difference between people downloading illegally and people downloading tracks given by the bands. Will France consider a musician don't have the right to give his music ?

2. How someone who's head of FNAC, the biggest seller of music AND computer products ( including those used for copying and playing illegal MP3s ), was found fiable to make a report and find solutions to a problem he's a important part of ?
